מדיניות פרטיות – אתר “MonteMare Homes“

מדיניות פרטיות

בעל האתר montemare.homes (להלן “האתר“) מכבד את פרטיות המשתמשים באתר שהוא מנהל ומפעיל. על כן החליט בעל האתר לפרסם את מדיניותו ביחס להגנת הפרטיות, והוא מתחייב כלפי המשתמש לקיים מדיניות זו.

מטרת מסמך המדיניות היא להסביר מהם נוהגי בעל האתר ביחס לפרטיות המשתמשים ובין היתר: איזה מידע נאסף על אודות המשתמשים וכיצד משתמש בעל האתר במידע, שנמסר לו על-ידי המשתמשים באתר או נאסף  בעת השימוש בו.

מדיניות הפרטיות הינה בהתאם לאמור בסעיף 11 לחוק הגנת הפרטיות התשמ”א 1981.

מדיניות הפרטיות מנוסחת בלשון זכר ומכוונת לכל המגדרים.

יובהר כי לא חלה על המשתמש כל חובה שבדין למסור את המידע.

סוג המידע הנאסף: 

בעת השימוש בשירותי האתר נאסף מידע על אודותיך, חלקו מזהה אותך אישית:

  • פרטי יצירת קשר, כגון שמך, כתובת דואר אלקטרוני, מספר טלפון;
  • מידע שהעברת במסגרת התכתבויות ו/או תקשורת עם האתר, לרבות מידע שהעברת על ההצעות והשירותים שעניינו אותך;

 

חלק מהמידע שנאסף אינו מזהה אישית, למשל:

  • סוג הדפדפן שממנו אתה צופה באתר,
  • סוג המכשיר שממנו אתה צופה באתר,
  • אופן השימוש באתר
  • מוצרים שהתעניינת בהם

 

רישום לשירותים באתר

ככל שיידרש מידע אישי בעת הרשמה לשירותים באתר או בעת רכישת מוצרים, בעל האתר יבקש ממך מידע הנחוץ למתן שירותי האתר.

איסוף המידע

הנתונים שיאספו וכן תכנים שהמשתמש מעלה ו/או משתף ו/או יוצר באתר, יישמרו ברשות בעל האתר. מסדי הנתונים מאוחסנים בשרתי אחסון. המשתמש באתר מצהיר כי הוא מסכים לשמירת מידע בשרתים אלו, אשר עשויים להיות בארץ או בחו”ל.

מטרות איסוף ושימוש במידע:

השימוש במידע שנאסף, ייעשה רק בהתאם למדיניות פרטיות זו, או בהתאם להוראות כל דין החל, על מנת –

  • לאפשר שימוש בשירותים שונים באתר
  • לשפר את השירותים והתכנים המוצעים באתר
  • לתקשר איתך ולהשיב לפניותיך.
  • לשנות או לבטל שירותים ותכנים קיימים
  • לצורך אספקת מוצרים ושירותים – לרבות פרסום מידע ותכנים
  • על מנת להתאים את המודעות שיוצגו בעת ביקורך באתר לתחומי העניין שלך
  • לצורך אכיפת כללים ונהלים באתר כפי שהם מופיעים בתנאי השימוש

  • עיבוד המידע מותר לפי דין.

דיוור ישיר אלקטרוני ויצירת קשר עם המשתמש

בעל האתר מעוניין לעדכן את המשתמשים לגבי עדכונים חשובים, התפתחויות ועניינים רלוונטיים אחרים הקשורים לאתר  ולשירותיו. על מנת להבטיח תקשורת רציפה ומעודכנת, בעל האתר רשאי לשלוח הודעות (נוטיפיקציות) למשתמשים.

כמו כן, בעל האתר מעוניין לשלוח אליך, מעת לעת, ניוזלטרים או הודעות אחרות במייל, ו/או במסרון SMS או בוואטסאפ, על אודות השירותים והמוצרים וכן מידע שיווקי ופרסומי.

מידע כזה יישלח אליך רק אם נתת הסכמתך המפורשת, ובכל עת תוכל לבטל את הסכמתך ולהפסיק לקבלו.

לא נמסור את המידע האישי שלך למפרסמים. עם זאת, אנו עשויים להעביר מידע סטטיסטי על פעילות המשתמשים באתר ובניוזלטר לצדדים שלישיים.

מסירת מידע לצד שלישי

בעל האתר לא יעביר לצדדים שלישיים את פרטיך האישיים והמידע שנאסף על פעילותך באתר אלא במקרים המפורטים להלן:

  • שם וכתובת המייל מועברים לספק מערכת הדיוור של האתר;
  • חלק מהמידע מועבר לספק אשר מספק שירותי אחסון לאתר;
  • מידע אודות השימוש והפעילות שלך באתר,  יעבור לפלטפורמות שיווק כגון META ו-GOOGLE  , TABOOLA TIK TOK ו/או פלטפורמות אחרות באמצעות קבצי COOKIES ו/או פיקסלים ;
  • במקרה של מחלוקת משפטית בינך לבין בית העסק שתחייב את חשיפת פרטיך;
  • אם תבצע באתר פעולות המנוגדות לחוק;
  • אם יתקבל צו בית משפט המורה למסור את פרטיך או מידע על אודותיך לצד שלישי
  • בעל האתר רשאי להעביר את המידע לאנשי מקצוע ו/או פלטפורמות ו/או שירותים אחרים בתחום השיווק והפרסום, למטרות עיבוד ואופטימיזציה;
  • בעל האתר רשאי להעביר פרטי יצירת קשר לשותפים עסקיים ו/או לבעלי עסקים שנותנים שירותים דומים או משלימים, בתמורה ו/או שלא בתמורה.
  • העברות בעלות עסקיות, מיזוגים וכיוצא בזה: במקרה של מיזוג, רכישה או העברה של נכסים, המידע האישי שלך עשוי להיות מועבר לצד שלישי כחלק מהעסקה, בתנאי שהתאגיד הנעבר יקבל על עצמו את הוראות מדיניות פרטיות זו;

עוגיות (Cookies)

עוגייה (קובץ “Cookie“) היא קוד אשר משמש לאימות, מעקב אחר נתוני גלישה וכן לשמירת מידע על אודות המשתמשים. כל עוגייה נוצרת על ידי שרת, ומועברת לדפדפן של המשתמש; הדפדפן שלך הוא זה ששומר עוגיות בזיכרון של המחשב או המכשיר שלך.

האתר משתמש בעוגיות לצורך תפעולו השוטף והתקין, ובכלל זה כדי לאסוף נתונים סטטיסטיים על המשתמש ביחס לשימוש באתר, לאימות פרטים, כדי להתאים את האתר להעדפותיך האישיות ולצורכי אבטחת מידע.

זכויות נשוא המידע

על-פי חוק הגנת הפרטיות, התשמ”א – 1981, כל אדם זכאי לעיין במידע על אודותיו, המוחזק במאגר מידע. אדם שעיין במידע שעליו ומצא כי אינו נכון, שלם, ברור או מעודכן, רשאי לפנות לבעל מאגר המידע בבקשה לתקן את המידע או למוחקו.

בנוסף, אם המידע שבמאגרי החברה משמש לצורך פניה אישית אליך, אתה זכאי על-פי חוק הגנת הפרטיות, התשמ”א- 1981 לדרוש בכתב שהמידע המתייחס אליך יימחק ממאגר המידע.

אנו נסקור ונעדכן באופן קבוע את מדיניות הפרטיות שלנו כדי להבטיח שהיא משקפת את נהלי הטיפול הנוכחיים שלנו בנתונים. כל העדכונים יימסרו לך בבירור, ואנו נקבל את הסכמתך ככל ויידרש על פי דין.

PURSUANT TO ART. 13 AND 14 OF THE EUROPEAN REGULATION ON THE PROTECTION OF PERSONAL DATA (GDPR)

The security and protection of your personal data is important for MonteMare Homes, which acts in accordance with the laws currently in force regarding the protection and the security of personal data. We trust that the information below will help you understand what kind of data MonteMareHomes, how we use the data, how we safeguard them and with whom we share them.

Pursuant to Articles 13 and 14 of EU Reg. 679/2016 (hereinafter also referred to as the “Privacy Regulation”), we therefore wish to inform you that your personal data will be processed in accordance with the principles of correctness, lawfulness and transparency, and by protecting your confidentiality and your rights, in compliance with the current legislation on security and protection of personal data.

In particular, we inform you of the following:

  1.   Source of personal data and type of data processed
     No registration is required to access the Site. However, there are some sections within the Site that require you to provide personal information for the only purposes of being able to receive services, such as subscribing to the newsletter, for contacting us, and for sending marketing communications and invitations to events.
    With reference to the data relating to navigation within the Site, see also point 6 below concerning the profiling tools used by the Site.
    The personal data in our possession are those provided by you when you access the website https://montemare.homes/ and its pages, as well as when you submit a request for information and/or when you request to subscribe to our newsletter service via the dedicated pages and checkboxes.
    All personal data will be processed in compliance with the Privacy Code, the “Privacy Regulations”, the provisions of the Guarantor for the protection of personal data and the confidentiality obligations that have always inspired the activities of our company.
  2.   Legal basis and Purposes of processing
     The purposes for which your data will be processed by us are as follows:

    The legal bases for such processing are:
    1)    the execution of pre-contractual measures taken at your request, pursuant to Art. 6, para. 1, lett. b) of the “Privacy Regulation”.
    2)    to meet legal obligations to which the data controller is subject, pursuant to Art. 6, paragraph 1, letter c) of the “Privacy Regulation”.
    3)    to pursue the legitimate interest of the data controller pursuant to Art. 6, paragraph 1, letter f) of the “Privacy Regulation”.

 

The data relating to connection and navigation within the Site (such as the URI-Uniform Resource Identifier addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other settings relating to the user’s operating system and computer environment) are collected for the only purpose of obtaining anonymous statistical information on the use of the Site and to check its correct operation, and are deleted immediately after processing. The data could be used to ascertain responsibility in the event of hypothetical computer crimes to the detriment of the Site: to the exclusion of this eventuality, the data will be deleted after the time required to provide the services illustrated on the Site has elapsed.

  1.     Processing requests and sending proposals and commercial communications
     The legal basis for such processing is the execution of pre-contractual measures taken at your request, pursuant to Art. 6, paragraph 1, letter b) of the “Privacy Regulation”, at the time your data is entered and the information request form is submitted by you.
    By processing the data provided by you, we will be able to reply to your requests sent to us by the website https://montemare.homes/ regarding the search for buying/selling/renting property. On the basis of your requests we will respond with commercial communications relating to your enquiries..
  2.   Newsletter subscription
     The legal basis for such processing is your explicit consent, pursuant to Art. 6, para. 1, letter a) of the “Privacy Regulation”.
    After collecting your consent in this matter and the data provided by you, we may send you our Newsletter, which is sent by automated means. To allow us to properly manage our Site and the Newsletter service you have requested, your personal data may be transferred to countries outside the European Union where the companies that provide these services are located.
  3.   Invitations to Events
     The legal basis for such processing is your explicit consent, pursuant to Art. 6, para. 1, letter a) of the ‘Privacy Regulation’.
    Subject to your prior consent, by processing the data provided by you, we will be able to send you information regarding news about our Company, as well as invitations to exclusive corporate events in which we would like you to participate, that will be sent – also by automated means – by e-mail or post. Even if you have given your consent, you may revoke it at any time by making a request to MonteMare Homes in the manner set out in point i below.
    You may also easily oppose further mailings by exercising your so-called right to opt-out, through the modalities present in each type of communication with which the marketing communications in question are sent.
    Once your consent has been revoked, you will receive confirmation of receipt of such revocation communication from MonteMare Homes.
    MonteMare Homes informs you, however, that, even after the exercise of such right of revocation, it is possible that, for technical and operational reasons (e.g. the formation of contact lists already completed shortly before the receipt by MonteMare Homes of the revocation itself), you will continue to receive certain further communications. Should you continue to receive Marketing communications from the exercise of the above right, please report the problem to MonteMare Homes, using the contact details set out in point i below.
  4.   Profiling and/or personalisation tools
     MonteMare Homes does not perform any profiling activities without the prior express consent of the user.
    The Site uses “cookies”, both technical (i.e. to facilitate navigation and use of the Site) and profiling (i.e. to analyse users and their behaviour and preferences, and thus customise the browsing experience).

  5.   Treatment methods
     The data will be processed manually or electronically, in such a way as to guarantee their security in relation to the purposes for which they were communicated and collected, and to prevent unauthorised access by third parties and, in any case, in compliance with national and European legislation. The processing is carried out by the Data Controller, by the Data Processors and by the persons assigned to the processing for this purpose.
  6.   Nature of assignment
     The provision of data in relation to the purposes set out in point b1. is compulsory as it is a necessary requirement in order to be able to respond to your requests and in the event of failure to provide such data, the consequences of your refusal will be that you will not be able to receive information relating to the information you have requested and for which you have expressed an interest.
    The provision of data in relation to the purposes set out in points b.2 and b.3 is optional, but is a necessary requirement in order to be able to receive marketing communications/invitations to events and the Newsletter from MonteMare Homes. We invite you not to provide, during the use of interactive services, sensitive data, i.e. data from which it may be possible to identify, by the way, your racial or ethnic origin, religious beliefs, political opinions, membership of parties, trade unions, associations and organisations of a religious, philosophical, political or trade-unionist character, as well as your state of health. Any sensitive data provided will be deleted immediately.
  7.   Authorized persons to process and communication of data
    Your personal data may be disclosed to employees engaged to perform for MonteMare Homes the activities necessary to achieve the purposes of the processing referred to in paragraph b. (b.1), (b.2) and (b.3) above.
    Suppliers of IT and logistics services functional to the operation of the site, suppliers of outsourced services, professionals and consultants, companies entrusted with the sending of commercial e-mails or communications on Events or the Newsletter (where you have consented to this) may also become aware of them.
    Such persons, formally appointed by MonteMare Homes as Persons authorized, the Data Processors and/or System Administrators, shall process your data in compliance with and exclusively for the purposes indicated in this policy and under the control and supervision of MonteMare Homes itself. The complete and updated list of the persons to whom your data have been communicated may be requested from the Data Controller, whom you may contact by writing to the e-mail address indicated in point i.
    Your personal data may also be shared with the Companies of the MonteMare Homes Group for the contractual and pre-contractual purposes referred to in point b.1. 
  8.   Data Dissemination
     Your personal data will not be disseminated by the data controller.
  9.   Transfer of data outside Europe
    Your personal data may be transferred abroad to countries that are not Members of the EEA (European Union, Iceland, Liechtenstein and Norway) and, in particular, to the companies that provide basic services for the operation of the site, for managing the application systems and for managing the sending of the Newsletter, on the basis of a contract of appointment and definition of the security measures necessary for the transfer of data from the Data Controller to the Processors with the consequent guarantee of data processing in compliance with European standards. External Processors may process personal data coming from MonteMare Homes only on the basis of instructions provided by the Data Controller and indicated in the deeds of appointment stipulated between the Data Controller and the Processors
  10.   Rights of the data subject
     ▪    Finally, we would like to inform you of the possibility of exercising the rights granted to you by law at any time, which are set out below:
    ▪    access to the data provided;
    ▪    obtain the rectification of the data provided, their deletion, transformation into anonymous form, the blocking of data processed in violation of the law or the restriction of data processing concerning you;
    ▪    object to data processing;
    ▪    revoke your consent;
    ▪    obtain portability of your data;
    ▪    obtain confirmation as to whether or not your data is being processed, know its content and source, check its accuracy or request that it be supplemented or updated, know the purposes and methods of data processing, the logic applied in case of processing by electronic means, the identification data concerning data controller, data processors, data processors and the DPO, if one is appointed
    ▪    lodging a complaint with the supervisory authority (Privacy Guarantor);
    ▪    object to an automated decision-making process concerning natural persons, including profiling;
    ▪    obtain, without undue delay, notice of a breach of your personal data.
    ▪    obtain a copy of the data being transferred countries outside the EEA, as well as the place where it is made available

  1.   Period of data retention
     The data provided by you in relation to purpose b.1) above shall be kept for the time necessary to process your request for information and, thereafter, for the time necessary for the performance of the contract, if one is concluded, following your request for information. Only in the event that you, by making an enquiry to our company, have also given your consent in relation to the purpose b.2 above, your data will be kept for a maximum period of five (5) years from the last contact and unless you request early deletion.
    The data provided by you in connection with purpose b.3 above shall be retained for the duration of your subscription to our Newsletter service or – in any event – until you revoke your consent (which can be requested at any time, including by using the link provided in all of our Newsletters); thereafter, the data shall be deleted or anonymised.

La sicurezza e la protezione dei vostri dati personali è importante per MonteMare Homes, che agisce in conformità con le leggi attualmente in vigore riguardanti la protezione e la sicurezza dei dati personali. Confidiamo che le informazioni seguenti vi aiuteranno a comprendere che tipo di dati raccoglie MonteMare Homes, come utilizziamo i dati, come li proteggiamo e con chi li condividiamo.

Ai sensi degli articoli 13 e 14 del Reg. UE 679/2016 (di seguito denominato anche “Regolamento Privacy”), desideriamo pertanto informarvi che i vostri dati personali saranno trattati nel rispetto dei principi di correttezza, liceità e trasparenza, e tutelando la vostra riservatezza e i vostri diritti, in conformità alla normativa vigente in materia di sicurezza e protezione dei dati personali.

In particolare, vi informiamo di quanto segue:

a. Fonte dei dati personali e tipologia di dati trattati

Non è richiesta alcuna registrazione per accedere al Sito. Tuttavia, vi sono alcune sezioni all’interno del Sito che richiedono di fornire informazioni personali al solo scopo di poter ricevere servizi, come l’iscrizione alla newsletter, per contattarci e per l’invio di comunicazioni commerciali e inviti ad eventi.

Con riferimento ai dati relativi alla navigazione all’interno del Sito, si veda anche il punto 6 di seguito relativo agli strumenti di profilazione utilizzati dal Sito.

I dati personali in nostro possesso sono quelli da voi forniti quando accedete al sito web https://montemare.homes/ e alle sue pagine, nonché quando presentate una richiesta di informazioni e/o quando richiedete di iscrivervi al nostro servizio di newsletter tramite le apposite pagine e caselle di controllo.

Tutti i dati personali saranno trattati nel rispetto del Codice Privacy, del “Regolamento Privacy”, delle disposizioni del Garante per la protezione dei dati personali e degli obblighi di riservatezza che da sempre ispirano le attività della nostra società.

b. Base giuridica e Finalità del trattamento

Le finalità per le quali i vostri dati saranno da noi trattati sono le seguenti:

1. Gestione dei dati di connessione e navigazione

Le basi giuridiche di tale trattamento sono:

  1. l’esecuzione di misure precontrattuali adottate su vostra richiesta, ai sensi dell’art. 6, comma 1, lett. b) del “Regolamento Privacy”.
  2. adempiere agli obblighi di legge cui è soggetto il titolare del trattamento, ai sensi dell’art. 6, comma 1, lettera c) del “Regolamento Privacy”.
  3. perseguire il legittimo interesse del titolare del trattamento ai sensi dell’art. 6, comma 1, lettera f) del “Regolamento Privacy”.

I dati relativi alla connessione e alla navigazione all’interno del Sito (quali gli indirizzi URI-Uniform Resource Identifier delle risorse richieste, l’ora della richiesta, il metodo utilizzato per sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (riuscita, errore, ecc.) e altre impostazioni relative al sistema operativo e all’ambiente informatico dell’utente) sono raccolti al solo scopo di ottenere informazioni statistiche anonime sull’uso del Sito e per verificarne il corretto funzionamento, e vengono cancellati immediatamente dopo il trattamento. Trattando i dati da voi forniti, potremo rispondere alle vostre richieste inviateci tramite il sito web https://montemare.homes/ riguardanti la ricerca di acquisto/vendita/affitto di immobili. Sulla base delle vostre richieste risponderemo con comunicazioni commerciali relative alle vostre richieste.

3. Iscrizione alla Newsletter

La base giuridica di tale trattamento è il vostro consenso esplicito, ai sensi dell’art. 6, comma 1, lettera a) del “Regolamento Privacy”.

Dopo aver raccolto il vostro consenso in materia e i dati da voi forniti, potremo inviarvi la nostra Newsletter, che viene inviata con mezzi automatizzati. 4. Inviti ad Eventi

La base giuridica di tale trattamento è il vostro consenso esplicito, ai sensi dell’art. 6, comma 1, lettera a) del “Regolamento Privacy”.

Previo vostro consenso, trattando i dati da voi forniti, potremo inviarvi informazioni riguardanti novità sulla nostra Società, nonché inviti ad eventi aziendali esclusivi ai quali desidereremmo la vostra partecipazione, che saranno inviati – anche con mezzi automatizzati – via e-mail o posta. Anche se avete prestato il vostro consenso, potrete revocarlo in qualsiasi momento rivolgendo richiesta a MonteMare Homes nelle modalità indicate al punto i qui di seguito.

Potrete inoltre opporvi facilmente a ulteriori invii esercitando il cosiddetto diritto di opt-out, attraverso le modalità presenti in ciascuna tipologia di comunicazione con cui vengono inviate le comunicazioni di marketing in questione.

Una volta revocato il vostro consenso, riceverete da MonteMare Homes conferma della ricezione di tale comunicazione di revoca.

MonteMare Homes vi informa, tuttavia, che, anche dopo l’esercizio di tale diritto di revoca, è possibile che, per ragioni tecniche e operative (ad es. la formazione di liste di contatti già completate poco prima della ricezione da parte di MonteMare Homes della revoca stessa), continuiate a ricevere alcune ulteriori comunicazioni. Qualora continuaste a ricevere comunicazioni di Marketing dopo l’esercizio del suddetto diritto, vi preghiamo di segnalare il problema a MonteMare Homes, utilizzando i recapiti indicati al punto i qui di seguito.

c. Strumenti di profilazione e/o personalizzazione

MonteMare Homes non effettua alcuna attività di profilazione senza il preventivo consenso esplicito dell’utente.

Il Sito utilizza “cookies”, sia tecnici (ovvero per facilitare la navigazione e l’uso del Sito) sia di profilazione (ovvero per analizzare gli utenti e il loro comportamento e preferenze, e quindi personalizzare l’esperienza di navigazione).

d. Modalità di trattamento

I dati saranno trattati manualmente o elettronicamente, in modo tale da garantirne la sicurezza in relazione alle finalità per le quali sono stati comunicati e raccolti, e per impedire l’accesso non autorizzato da parte di terzi e, in ogni caso, nel rispetto della normativa nazionale ed europea. Il trattamento è effettuato dal Titolare del trattamento, dai Responsabili del trattamento e dalle persone incaricate del trattamento a tale scopo.

e. Natura del conferimento

Il conferimento dei dati in relazione alle finalità di cui al punto b1. è obbligatorio in quanto requisito necessario per poter rispondere alle vostre richieste e in caso di mancato conferimento di tali dati, le conseguenze del vostro rifiuto saranno che non potrete ricevere informazioni relative alle informazioni da voi richieste e per le quali avete manifestato interesse.

Il conferimento dei dati in relazione alle finalità di cui ai punti b.2 e b.3 è facoltativo, ma costituisce requisito necessario per poter ricevere comunicazioni commerciali/inviti ad eventi e la Newsletter da parte di MonteMare Homes. Vi invitiamo a non fornire, durante l’uso dei servizi interattivi, dati sensibili, ovvero dati dai quali possa essere possibile identificare, per via indiretta, la vostra origine razziale o etnica, le convinzioni religiose, le opinioni politiche, l’appartenenza a partiti, sindacati, associazioni ed organizzazioni a carattere religioso, filosofico, politico o sindacale, nonché il vostro stato di salute. Eventuali dati sensibili forniti saranno cancellati immediatamente.

f. Soggetti autorizzati al trattamento e comunicazione dei dati

I vostri dati personali potranno essere comunicati a dipendenti incaricati di svolgere per MonteMare Homes le attività necessarie al raggiungimento delle finalità del trattamento di cui al paragrafo b. (b.1), (b.2) e (b.3) sopra.

Potranno inoltre venirne a conoscenza i fornitori di servizi informatici e logistici funzionali al funzionamento del sito, i fornitori di servizi in outsourcing, professionisti e consulenti, società incaricate dell’invio di e-mail commerciali o comunicazioni su Eventi o la Newsletter (laddove abbiate prestato il vostro consenso).

Tali soggetti, formalmente nominati da MonteMare Homes quali Soggetti autorizzati, Responsabili del trattamento e/o Amministratori di sistema, tratteranno i vostri dati nel rispetto e esclusivamente per le finalità indicate nella presente informativa e sotto il controllo e la vigilanza di MonteMare Homes stessa. L’elenco completo e aggiornato dei soggetti ai quali sono stati comunicati i vostri dati può essere richiesto al Titolare del trattamento, che potrete contattare scrivendo all’indirizzo e-mail indicato al punto i.

I vostri dati personali potranno inoltre essere condivisi con le Società del Gruppo MonteMare Homes per le finalità contrattuali e precontrattuali di cui al punto b.1.

g. Diffusione dei dati

I vostri dati personali non saranno diffusi dal titolare del trattamento.

h. Trasferimento dei dati al di fuori dell’Europa

I vostri dati personali potranno essere trasferiti all’estero in paesi che non sono Membri dello SEE (Unione Europea, Islanda, Liechtenstein e Norvegia) e, in particolare, alle società che forniscono servizi di base per il funzionamento del sito, per la gestione dei sistemi applicativi e per la gestione dell’invio della Newsletter, sulla base di un contratto di nomina e definizione delle misure di sicurezza necessarie per il trasferimento dei dati dal Titolare del trattamento ai Responsabili con la conseguente garanzia del trattamento dei dati nel rispetto degli standard europei. I Responsabili esterni potranno trattare dati personali provenienti da MonteMare Homes solo sulla base delle istruzioni fornite dal Titolare del trattamento e indicate negli atti di nomina stipulati tra il Titolare del trattamento e i Responsabili.

i. Diritti dell’interessato

Desideriamo infine informarvi della possibilità di esercitare in qualsiasi momento i diritti che vi sono riconosciuti dalla legge, che sono riportati di seguito:

▪ accedere ai dati forniti;

▪ ottenere la rettifica dei dati forniti, la loro cancellazione, la trasformazione in forma anonima, il blocco dei dati trattati in violazione di legge o la limitazione del trattamento dei dati che vi riguardano;

▪ opporsi al trattamento dei dati;

▪ revocare il vostro consenso;

▪ ottenere la portabilità dei vostri dati;

▪ ottenere la conferma dell’esistenza o meno di un trattamento dei vostri dati, conoscerne il contenuto e l’origine, verificarne l’esattezza o chiedere che siano integrati o aggiornati, conoscere le finalità e le modalità del trattamento dei dati, la logica applicata in caso di trattamento con mezzi elettronici, gli estremi identificativi concernenti il titolare del trattamento, i responsabili del trattamento, gli incaricati del trattamento e il DPO, se nominato;

▪ proporre reclamo all’autorità di controllo (Garante Privacy);

▪ opporsi a un processo decisionale automatizzato relativo alle persone fisiche, compresa la profilazione;

▪ ottenere, senza indebito ritardo, la notifica di una violazione dei vostri dati personali;

▪ ottenere copia dei dati oggetto di trasferimento in paesi al di fuori dello SEE, nonché il luogo in cui è resa disponibile.

j. Periodo di conservazione dei dati

I dati da voi forniti in relazione alla finalità b.1) di cui sopra saranno conservati per il tempo necessario al trattamento della vostra richiesta di informazioni e, successivamente, per il tempo necessario all’esecuzione del contratto, qualora ne venga stipulato uno, a seguito della vostra richiesta di informazioni. Solo nel caso in cui voi, rivolgendo una richiesta alla nostra società, abbiate prestato anche il vostro consenso in relazione alla finalità b.2 di cui sopra, i vostri dati saranno conservati per un periodo massimo di cinque (5) anni dall’ultimo contatto e salvo che non richiediate la cancellazione anticipata.

I dati da voi forniti in relazione alla finalità b.3 di cui sopra saranno conservati per la durata della vostra iscrizione al nostro servizio Newsletter o – in ogni caso – fino alla revoca del vostro consenso (che può essere richiesta in qualsiasi momento, anche utilizzando il link fornito in tutte le nostre Newsletter); successivamente, i dati saranno cancellati o resi anonimi.
